Dr House — emergency department triage decision support

This was written by the build team to be a sound starting point, not by counsel. It has not been reviewed against Romanian or EU law, against any hospital’s procurement requirements, or against medical device regulation. Do not rely on it, and do not put this product in front of a clinical customer until a qualified lawyer has been over it. Section 3 in particular needs a regulatory opinion, not a developer’s view.

1. Who this agreement is with

Dr House is operated by ACE AI Spark, Inc. (“we”). These terms govern use of the software at drhouse.aceaispark.com by an organisation and its authorised staff (“you”).

2. What the software does, and does not do

Dr House structures a triage assessment and calculates a suggested Australasian Triage Scale category from findings entered by a clinician. It does not examine patients, does not observe them, and has no information beyond what is typed into it.

The suggestion is not a clinical decision. The category assigned to a patient is assigned by a registered clinician exercising their own judgement, who may depart from the suggestion at any time and for any reason. The software does not treat, diagnose, prescribe, or triage; a person does.

We do not warrant that a suggestion is correct, complete, or appropriate for any patient. Clinical responsibility for every patient remains entirely with the treating clinician and the operating organisation.

3. Regulatory status

Unresolved — requires a regulatory opinion

Software that supports clinical decisions may fall within the EU Medical Device Regulation (2017/745), and guidance (MDCG 2019-11) indicates that software informing triage or prioritisation can be classified as a medical device, potentially Class IIa. Dr House has not been assessed against that framework, is not CE marked, and carries no conformity assessment.

Until that assessment is done, Dr House must be used only for evaluation and must not be relied upon in the care of real patients.

4. Permitted use during the pilot

Access is limited to clinical and operational staff your organisation has authorised.
Accounts are personal. Credentials must not be shared, and each account is attributable to one named individual.
No real patient-identifying data may be entered. Location labels only.
The software must not be used as the sole basis for prioritising the care of a real patient.

5. The record we keep

Each triage is written once and cannot be edited or deleted, by you or by us. A correction is recorded as a new entry. Where a clinician departs from a suggestion, the reason they give is stored with the entry. This is deliberate: it is what makes the system auditable and what allows the rules to be improved.

6. Availability

Dr House is provided during the pilot without any service level commitment. It may be unavailable, changed, or withdrawn without notice. It must never sit on the critical path of patient care, and your triage process must remain fully workable when it is unavailable.

7. The avatar

The second-opinion feature uses a synthetic avatar with a generated voice and a language-model-generated response. It is not a person and not a clinician. It is instructed not to state a triage category, and anything it says is discussion, not advice. It is recorded and transcribed — see the Privacy Policy. The name “Dr House” is an internal working title; the product is not associated with, endorsed by, or derived from any television programme or its rights holders.

8. Liability

To the fullest extent permitted by law, we exclude liability for clinical outcomes, for decisions made by clinicians using the software, and for indirect or consequential loss. Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence.

The scope and enforceability of this section is exactly what counsel needs to look at. A liability exclusion in a clinical context is not something to take on trust from a template.

9. Intellectual property

We retain all rights in the software. You retain all rights in the data you enter. Triage records belong to your organisation; we process them on your instructions as described in the Privacy Policy.

10. Ending the pilot

Either party may end the pilot at any time in writing. On request we will export your organisation’s records in a machine-readable form and delete them, subject to any retention we are legally required to observe.
